Art 39 GDPR sets out the task of the DPO:

  • to inform and advise the controller on obligations pursuant to this Regulation
  • to monitor compliance with this Regulation, and with the policies of the controller or processor, including the assignment of responsibilities, awareness-raising and training of staff involved in processing operations, and the related audits
  • to provide advice where requested as regards the data protection impact assessment and monitor its performance pursuant to Article 35
  • to cooperate with the supervisory authority
  • to act as the contact point for the supervisory authority on issues relating to processing, including the prior consultation referred to in Article 36, and to consult, where appropriate, with regard to any other matter

The primary role of the External DPO is to assist an organisation to process the personal data of its staff, customers, providers, and any other data subjects in compliance with the applicable data protection legislation.

How we deliver our External DPO services

In order to deliver our External DPO services to you efficiently and effectively we will appoint a dedicated External DPO lead, who will be your main point of contact and who will take ownership of fulfilling the DPO responsibilities. Your External DPO lead will be supported by our team of consultants with a senior consultant providing project management support.

Our Onboarding Programme ensures your Pembroke Privacy External DPO quickly understands your data protection programme and any risks that may be present. Our DPO Programme Dashboard assists us to manage identified deliverables and deadlines. Our Method of Reporting will keep stakeholders up to date on progress regularly with specific reports to senior management and an annual DPO Report to Board Members.

Ongoing Monitoring and Support Services

A key task of the DPO is to advise and monitor. Our External DPO service aims achieve an appropriate level of compliance that matches industry competitors and meets legal requirements and guidance from regulators. We will achieve this by doing the following:

  • Carry out governance meetings, reporting as appropriate and as set out below.
  • Reporting to the board or senior management team on risk and compliance levels
  • Create/Review existing Data Protection Monitoring Plans and advise on implementation.
  • Assist in carrying out Data Protection Impact Assessments (DPIAs). We can also help create a Data Protection Impact Assessment (DPIA) programme including templates and training.
  • Carry out data protection audits and/or review audit results, using a risk register to track risk.
  • Engage with and manage any queries/investigations arising with Data Protection Regulators.
  • Act as point of contact for your employees and data subjects.
  • Ongoing review and updating of policies and procedures to ensure they are in line with evolving guidance.
  • Data Breaches: assistance with managing and notifying Data Security Breaches, as required.
  • Assistance with Data Subject Access Requests (DSARs). We have developed a State-of-the-Art DSAR process which we use to ensure that data subject rights are managed efficiently and appropriately.
  • Monitor compliance with data protection requirements on an ongoing basis.
  • Advice on changes to any international data transfers where your organisation allows its data to be transferred outside Europe.
  • Ensure that the Record of Processing Activity (ROPA) is kept up to date.
  • We can create and deliver a training programme to raise awareness of data protection and specific issues as they apply to your organisation. This training programme can be delivered either in person (when possible) or via online live training using training platforms such as Microsoft Teams or via our bespoke Pembroke Privacy eLearning system. We have different training programmes available, ranging from high level “awareness raising” training which would be suitable for general staff and targeted training e.g., data breaches; DPIAs; training for functions e.g., HR or marketing. We will also offer IAPP’s CIPP/E, CIPM and CIPT training for your Privacy Team.
